By using QTAG, you agree to our terms and conditions. Please read these terms carefully before using our service.
1. Service Availability and Uptime Commitments
QTAG Solutions strives to maintain high service availability, but we cannot guarantee 100% uptime. We commit to:
- Maintaining 99.5% uptime availability
- Providing advance notice of scheduled maintenance
- Implementing reasonable measures to prevent service interruptions
- Responding to service issues within 24 hours during business days
Service interruptions due to circumstances beyond our control (including but not limited to natural disasters, internet outages, or third-party service failures) are not covered by this commitment.
2. User Responsibilities and Acceptable Use
As a QTAG user, you are responsible for:
- Maintaining the confidentiality of your account credentials
- Using the service in compliance with all applicable laws and regulations
- Not sharing your account with unauthorized users
- Ensuring the accuracy of data entered into the system
- Regular backup of your data
Prohibited Activities
You agree not to:
- Use the service for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to the system or other users' accounts
- Interfere with or disrupt the service or servers
- Upload malicious code or attempt to compromise system security
- Use the service to transmit spam or unsolicited communications
3. Intellectual Property Rights
QTAG and all related trademarks, logos, and intellectual property are owned by QTAG Solutions. You may not:
- Copy, modify, or distribute QTAG software without permission
- Reverse engineer or attempt to extract source code
- Use QTAG trademarks or logos without written consent
- Create derivative works based on QTAG
You retain ownership of your data and content, but grant QTAG Solutions a license to use, store, and process your data as necessary to provide the service.
4. Limitation of Liability
To the maximum extent permitted by law:
- QTAG Solutions provides the service "as is" without warranties of any kind
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid for the service in the 12 months preceding the claim
- We are not responsible for data loss, business interruption, or other damages resulting from service use
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so these limitations may not apply to you.
5. Termination and Suspension Policies
Account Termination
You may terminate your account at any time by contacting support. We may terminate your account if:
- You violate these terms and conditions
- You fail to pay subscription fees
- Your account remains inactive for more than 12 months
- We discontinue the service
Data Retention After Termination
Upon account termination:
- Your data will be retained for 30 days for recovery purposes
- After 30 days, your data will be permanently deleted
- You may request data export before termination
- Some data may be retained for legal or regulatory compliance
6. Dispute Resolution Procedures
Informal Resolution
Before pursuing formal legal action, we encourage you to contact our support team to resolve any disputes informally.
Governing Law
These terms are governed by the laws of Australia. Any disputes will be resolved in the courts of Australia.
Arbitration
For disputes involving amounts less than $10,000, either party may request binding arbitration instead of court proceedings.
Class Action Waiver
You agree to resolve disputes individually and waive the right to participate in class action lawsuits.
7. Changes to Terms
We may update these terms and conditions from time to time. When we make changes:
- We will notify users via email or in-app notification
- Material changes will require your acceptance
- Continued use of the service constitutes acceptance of updated terms
- Previous versions of terms will be archived for reference
